Under the revised (new) Bankruptcy Code, debtors will be reuired to obtain before filing of Bankruptcy, Credit counseling before the debtor will be elgible to file for relief with the Bankruptcy Court. In addition, the debtor will also be rquired to obtain what might be referred to as post-Bankruptcy (or after Bankruptcy) counseling education before discharge by the Bankruptcy Court.
The required counseling education must be done by and through a non-profit, and Court approved agency, providing credit counseling.
Specifically, the Debtor(s) must file a certificate provided by an approved agency, which states that the debtor has received counseling in regard to various credit and debt remedies, as well as received education and assistance in conducting a budget analysis. This counseling must take place within 6 months prior to the Bankruptcy filing.
